The city of Aspen is embarking on modernizing its non-discrimination ordinance, which is considered one of the most progressive of its time and has served this community well for the past 47 years. Adopted in 1977, the ordinance was cutting edge and was the state&rsquo;s first anti-gay discrimination law, followed by Boulder in 1987 and Denver in 1991. Based on this instrumental ordinance, the city was one of the successful plaintiffs in Romer v. Evans, 517 U.S. 620, 116 S.Ct.1620 (1996), which overturned the Colorado state constitutional amendment that was passed by the voters. This amendment would have permitted discrimination based on affectional and sexual orientation.  The current ordinance prohibits discriminatory practices related to employment, housing, and public services and accommodations. Ordinance No. 60 describes discrimination or to discriminate as meaning, without limitation, &ldquo;any act which because of race, color, creed, religion, ancestry, national origin, sex, age, marital status, physical handicaps, affectional or sexual orientation, family responsibility, or political affiliation, results in the unequal treatment or separation of any person or denies, prevents, limits or otherwise adversely affects, the benefit or enjoyment by any person of employment, ownership or occupancy of real property or public services or accommodations.&rdquo;  The city has been working for over a year towards modernizing the groundbreaking ordinance from 1977.  A few general themes related to the recent updates made to the ordinance include but are not limited to the expansion of protected classes, refreshing language to be increasingly inclusive throughout, and the expansion of the element of proof of discrimination based on updated legislation. The Aspen Police Department and the Aspen-Pitkin County Housing Authority were included in gathering feedback for the ordinance as internal stakeholders. The proposed revised ordinance also was reviewed by two diversity, equity and inclusion consultants. Aspen City Council is scheduled to discuss the proposed ordinance on Aug. 12, 2024. Aspen's Safety Action Plan

Project Overview:The City of Aspen is proposing to amend its Federal Energy Regulatory Commission (FERC) license for the Ruedi hydroelectric project to install a second turbine and generator within the existing powerhouse located at Ruedi dam. The purpose of the second turbine and equipment improvements is to restore the project to achieve the approved 5 MW of power generation on a more regular basis.Project Background:<div class="OutlineElement Ltr SCXW67259690 BCX0">Aspen&rsquo;s existing FERC license authorizes Aspen to generate 5 MW of hydroelectric energy whenever the Bureau of Reclamation releases water from Ruedi Reservoir to the Fryingpan River. The Bureau of Reclamation releases water to the river at higher flow levels than it had in the past to provide fish flows downstream. These flow levels are different than what the existing turbine and generator were designed for, and Aspen is less frequently able to produce the authorized capacity of 5 MW. </div><div class="OutlineElement Ltr SCXW67259690 BCX0">The new turbine and generator will operate at flow rates outside the range of the existing equipment, allowing the combined facilities to generate the 5 MW of hydroelectric energy. These proposed modifications will entail a small expansion to the existing powerhouse; installation of new electrical equipment; and the addition of a second tailrace (in the same location as the existing tailrace) to release water back to the river from the second generator when it is operating. Ruedi Federal Energy Regulatory Commission (FERC) Amendment

Project Overview:The City of Aspen, Colorado (Aspen) hereby files its Notice of Intent (NOI) to file an application to continue to operate Maroon Creek Hydroelectric Project, FERC Project No. 10441, under a subsequent license for a minor water power project (&sect;4.60) or under a small hydroelectric power project exemption from licensing (&sect;4.101). Aspen understands, and will emphasize to stakeholders during pre-filing consultation, that the &ldquo;exemption&rdquo; is, in fact, an authorization from FERC and requires compliance with not only the terms and conditions of the authorization, but the continued oversight from FERC to comply with other applicable federal laws and regulations, including, for example, the Endangered Species Act and the National Historic Preservation Act. Aspen intends to use the Traditional Licensing Process and the pre-filing consultation with stakeholders to evaluate both options for subsequent authorization.Project Background:The Maroon Creek Hydroelectric Project has been in operation since 1988 under a license from FERC. The existing license expires in 2028, and as required by regulation, Aspen must submit a Notice of Intent to FERC to continue plant operations. The notice is required five years in advance of the license expiration date. The project has served as a key element in Aspen&rsquo;s portfolio of local energy sources, and along with other local hydroelectric generation, allowed Aspen to become one of the first three electric utilities in the nation to achieve delivery of 100% renewable energy to its&rsquo; electric customers. The characteristic availability of hydroelectric energy allows scheduling to be accomplished on a predictable basis. Balancing supply and demand was an important consideration in Aspen&rsquo;s selection of a strategy to make newer renewable energy sources, such as wind, more reliable. The balanced mix of energy types enabled Aspen to reach its&rsquo; goal of 100% renewable energy beginning in 2014. The newer sources added by Aspen were intermittent in nature and presented difficulty in scheduling to precisely match customer demands. Currently at a national level, there is a similar emphasis in facilitating the switch from fossil fuel energy sources to renewable sources such as wind and solar in order to reach climate related goals. The switch at a national level presents similar challenges in balancing energy supply with demand and must be accomplished on a strict timetable.A high percentage of the nation&rsquo;s hydroelectric generation capacity is aging and many permits will expire in the next decade. Ensuring continued generation of power from the existing national hydropower fleet over the long term requires reinvestment as these plants age. As with the strategy selected locally, matching these requirements will require the continued availability of a reliable base load source such as hydroelectric power. Recognizing the challenge of financing the needed improvements, Congress passed amendments to the Federal Energy Policy Act of 2005 as part of the Inflation Reduction Act. Those amendments provide for substantial financial benefits for maintaining and increasing power generation at existing dams. Expansion of the generating capacity at Maroon Creek and other hydroelectric power sources owned by the City of Aspen is anticipated to qualify for this federal assistance. Aspen proposes to study the addition of increased generation at the Maroon Creek facility. This project alternative is known as the Maroon Creek Micro Hydro proposal.
